Justin Baldoni’s Team Withdraws Taylor Swift Subpoena Amid Blake Lively Legal Battle

And in their most recent showdown, Lively’s team hasslammed the claim made by Baldoni’s team that her choice to drop her intentional infliction of emotional distress and negligent infliction of emotional distress claims has anything to do with her unwillingness to share related medical records.
“Once again this is a routine part of the litigation process that is being used as a press stunt,” Lively’slawyersEsraHudsonandMike Gottliebshared in a statement with E! News. “We are doing what trial lawyers do: preparing our case for trial by streamlining and focusing it; they are doing what they do: desperately seeking another tired round of tabloid coverage.”
They continued, “Ms. Lively continues to allege emotional distress, as part of numerous other claims in her lawsuit, such as sexual harassment and retaliation, and massive additional compensatory damages on all of her claims.”
A letter filed by her team on June 2 and obtained by E! News claims that the legal teams for both parties had met via teleconference and agreed that the claims would be dropped from this case—with “modest revisions” from Lively’s team they say Baldoni’s team did not object to or “raise any concern” regarding.
However, Lively’s lawyers allege in the letter that later that same day, following the teleconference, the team behind the Wayfarer Parties (Baldoni, his Wayfarer Studios and other parties named in the suit) filed a motion alleging Lively was dropping the claims because she refused to share medical information relevant to her emotional distress claims.

Lively’s letter also asks presiding JudgeLewis Limanthat her claims be dismissed without prejudice, meaning they can be refiled at a later date should she so wish.
In turn, Baldoni’s team called out this request, writing in its filing,obtained byVariety,“In other words, Ms. Lively wants to simultaneously: (a) refuse to disclose the information and documents needed to disprove that she suffered any emotional distress and/or that the Wayfarer Parties were the cause; and (b) maintain the right to re-file her IED Claims at an unknown time in this or some other court after the discovery window has closed.”
However, Lively’s team slammed the allegations.

“To suggest that Ms. Lively has ‘refused’ to produce anything (in either her written discovery responses, in the parties’ conference, or anytime thereafter),” her team writes in their June 2 letter, “in connection with these claims is intentionally misleading to the Court and their intended audience for this false record: the public.”
E! News reached out to Baldoni’s legal team for comment.
